Streamlined Filing
Late FBARs vs. Streamlined Filing: Key Differences
Compare ordinary late FBAR filing with Streamlined Foreign Offshore Procedures: reporting scope, eligibility, records, certification and penalty limits.
Start with two questions: Were the account reports missing, and were the tax returns correct? A foreign account can create an FBAR obligation even if it earned no income. Conversely, submitting the missing FBAR does not repair unreported interest, a missing Form 8938, or a foreign-company return.
This comparison focuses on ordinary late FBAR reporting and Streamlined Foreign Offshore Procedures. The domestic Streamlined procedure has different requirements and penalty terms; living abroad today does not automatically place someone in the foreign procedure.
Compare the scope before choosing a route
| Question | Ordinary late FBAR filing | Streamlined Foreign Offshore Procedures |
|---|---|---|
| What is corrected? | Missing FinCEN Form 114 account reports; other tax defects require separate attention | A coordinated package for eligible non-willful offshore tax failures, including required returns, information returns and delinquent FBARs |
| What starts the review? | Account history, required years, reported income, other forms and agency contact | All those facts, plus the procedure's general eligibility and non-residency requirements |
| Which years? | Confirm from the actual reporting history and applicable rules; do not assume six years settles every case | Generally the most recent three return years and six FBAR years for which the relevant due dates have passed; section 965 can require additional return years |
| What explanation? | Select the applicable late-filing reason in FinCEN's system; use “other” and a written explanation when needed | Form 14653 with a complete, truthful non-willful certification, plus the required FBAR procedure selection and submission steps |
| What payment? | FBAR itself does not calculate income tax; omitted income needs its own analysis | Full tax and interest due with the submission |
| What penalty result? | An explanation alone does not promise a waiver | The IRS specifies relief for eligible taxpayers who follow all instructions; prior assessments are not automatically abated and filings can be examined |

What about the “Delinquent FBAR Submission Procedures” name?
Older articles use that name for a narrowly described correction pathway. Do not treat an old description, a broken agency link, or a remembered penalty promise as today's filing instruction. Use the current IRS FBAR page and FinCEN instructions above, and confirm the treatment of your facts before relying on a historical procedure description. The disappearance of a webpage does not, by itself, establish a legal effective date or an individual penalty outcome.
Also distinguish FBARs from delinquent international information returns. Forms such as 3520 or 5471 are not FinCEN Form 114. Guidance for those returns does not automatically provide FBAR relief.
Three hypothetical situations
Account reports only appear missing. Dana has copies of filed U.S. returns, reported the account interest, and finds no FBAR confirmations for two years. Before narrowing the work to FBARs, check whether the accounts were reportable, whether Forms 8938 or other forms were also required, and whether there has been agency contact. If the return history is correct, do not add an unrelated Streamlined package solely because an FBAR was late.
Returns and income also need correction. Eli discovers omitted foreign interest and missing information returns while living overseas. That is a broader correction review. Streamlined Foreign Offshore may be relevant if the actual eligibility and non-residency tests are met and a truthful non-willful certification can be made. A foreign address or a statement that the omission was accidental is not the whole eligibility analysis.
There is an examination or concern about deliberate conduct. Fran has a current examination notice or records showing a deliberate decision not to report. Preserve those records and obtain qualified tax counsel before selecting a submission. Do not rewrite the history to fit a non-willful narrative. The IRS Streamlined overview describes examination and investigation restrictions.
These examples organize the questions; none establishes eligibility or predicts penalties.
Build one year-by-year inventory
| Year | Tax return and foreign income | FBAR and other forms | Evidence or unresolved question |
|---|---|---|---|
| Each affected year | Filed, unfiled or unknown; income included or uncertain | Confirmation found, missing or unknown; list other international forms | Statements, prior advice, travel dates, notices and records requested |
Record unknown when a copy is missing. For each account, gather the owner, institution, country, dates open/closed, currency and maximum-value records. Include sole, joint and signature-authority accounts. For each return, check foreign income, entities, trusts, funds and gifts separately; an account-only inventory misses other reporting.
For a narrative, assemble the chronology: what happened, what you understood at the time, advice received, when the problem was discovered and steps taken afterward. A sample cover letter cannot supply these facts or determine non-willfulness. Keep contradictory evidence in the file and resolve it honestly.

Perguntas Frequentes
Is filing a delinquent FBAR the same as Streamlined Filing?
No. FinCEN's late-filing instructions concern the account report and its explanation. Streamlined Foreign Offshore Procedures have separate eligibility, non-residency, return, payment and certification requirements. Filing an FBAR does not correct omitted income or another information return.
Does every late FBAR require six years of filings?
No universal six-year rule applies to every late-filing situation. Six FBAR years is part of the Streamlined package, measured by the applicable due dates. Disclose the complete history and confirm the years appropriate to the selected route.
Does a late-FBAR explanation guarantee no penalty?
No. FinCEN requires a reason for late filing, but supplying an explanation does not by itself determine penalty relief. Eligibility and compliance with all Streamlined instructions matter for that procedure's stated relief.
What if I have received an IRS letter?
Disclose the letter and its deadline. An ordinary letter is not necessarily an examination, but a current IRS civil examination or criminal investigation makes a taxpayer ineligible for Streamlined procedures. Obtain appropriate advice for enforcement or willfulness concerns.
