U.S. Expats Married to Foreign Spouses: Filing and Reporting Guide
A practical guide to filing status, the nonresident-spouse election, worldwide income, foreign accounts, and tax planning for Americans married abroad.
U.S. Expats Married to Foreign Spouses: Filing and Reporting Guide
Marriage to a non-U.S. spouse creates a filing-status decision, not an automatic filing strategy. The spouse’s residency status, identification, worldwide income, foreign accounts, community-property law, and the couple’s goals should be mapped before choosing joint or separate filing.
Joint filing and the resident-spouse election
A U.S. citizen or resident may elect to treat a nonresident alien spouse as a U.S. resident for the tax year and file jointly. This can open or change credits and tax brackets, but it generally brings the spouse’s worldwide income into the U.S. return and creates an ongoing information and recordkeeping obligation.
Read the election language and consent requirements in the current Form 1040 instructions. Keep the marriage certificate, identification documents, foreign income records, and signed statements used for the election.
Separate filing is not always simpler
Married filing separately may avoid the resident-spouse election, but it can alter standard deductions, credits, IRA eligibility, community-property allocation, and the reporting of jointly held assets. A separate return still requires a complete review of the U.S. taxpayer’s worldwide income and foreign accounts.
Foreign-spouse accounts and assets
Review accounts where the U.S. spouse has financial interest, joint ownership, signature authority, or other access. The FBAR and Form 8938 rules are not identical. A foreign spouse’s account may be outside the U.S. taxpayer’s filing if the facts and exceptions support that result, but a blanket “my spouse owns it” assumption is unsafe.
Foreign income and currency
Collect the spouse’s wages, business income, pensions, interest, dividends, gains, rental income, and local tax returns when a joint return includes worldwide income. Convert amounts using a documented method and keep the local records. Foreign tax credits may be available, but source, basket, and creditability rules still apply.
Children, gifts, and inherited accounts
Birth or adoption certificates, foreign education accounts, gifts, inheritances, and trusts can introduce additional reporting. Review Form 3520, Form 8938, FBAR, and any treaty or community-property issue separately.
Scope boundary
This guide is educational and does not determine residency, community-property treatment, immigration status, or the best filing status. FileAbroad can model the federal expat return within a written scope through the tax filing intake. Immigration, family-law, and local-law questions require appropriate specialists.

Can I file jointly with a nonresident alien spouse?
A U.S. citizen or resident may generally be able to elect to treat a nonresident alien spouse as a resident for the tax year and file jointly, subject to the consent, identification, and worldwide-income consequences in the current instructions.
What happens if I file separately?
Married filing separately can avoid the resident-spouse election, but it may change deductions, credits, thresholds, and community-property reporting. The choice should be modeled rather than assumed.
Does my foreign spouse’s bank account go on my FBAR?
Ownership, joint access, signature authority, and the applicable exceptions matter. A spouse’s account is not automatically yours, but do not omit an account without analyzing the relationship and filing status.
Does my spouse need a Social Security number?
The identification requirement depends on the filing position and the spouse’s eligibility for an SSN or ITIN. Use the current IRS instructions and application process.
