Crypto Taxes for Americans Abroad
Digital assets create an unusually important separation between tax income and foreign-asset reporting. A U.S. person abroad may need to analyze sales and exchanges, staking or rewards, foreign exchange custody, Form 8938, FBAR, foreign entities, and state taxes. The word “crypto” is not a classification.
Map custody first
Create a wallet and platform inventory:
- Self-custodied wallets where you control the keys.
- U.S. exchanges and custodians.
- Foreign exchanges or custodians and their legal entities.
- DeFi protocols, lending platforms, and liquidity pools.
- Accounts owned by a business, trust, partnership, or spouse.
Preserve the platform terms, entity country, account opening records, and custody model. A private wallet and a foreign custodial account can produce different information-reporting questions.
Identify taxable events
Review sales, swaps, crypto-to-crypto exchanges, payments for goods or services, staking, mining, lending, airdrops, forks, and compensation. Track basis, fair-market value, fees, holding period, and the currency used. Transfers between wallets are not automatically sales, but the records must show what moved and who controlled it.
Foreign exchange and FATCA questions
Form 8938 and the FBAR have different definitions and thresholds. A foreign exchange may be a foreign financial institution or provide a reportable account, but that conclusion requires current guidance and platform facts. A self-custodied wallet may not be the same as an account maintained by a foreign institution.
Do not use a generic “always report crypto” or “crypto is never an FBAR account” rule. Review the filing year and preserve the conclusion.
Foreign entities and DeFi
If a company, partnership, trust, or nominee holds the digital assets, the entity’s classification and information returns may matter. DeFi positions may involve multiple contracts, tokens, governance rights, loans, and income types. Complex arrangements should be escalated rather than forced into a simple brokerage template.
Recordkeeping checklist
Keep complete exchange CSVs, wallet exports, transaction hashes, cost basis, fair-market values, staking and rewards statements, platform terms, foreign tax records, and the conversion method. Reconcile the activity to bank transfers and the final tax return.

Do I report crypto income on my U.S. return?
Sales, exchanges, rewards, staking, mining, and other digital-asset activity can create U.S. income or basis-reporting questions. The transaction history and the current IRS instructions control.
Does a foreign crypto exchange require an FBAR?
The answer depends on custody and the platform’s account structure and current FinCEN guidance. A foreign exchange and a self-custodied wallet are not identical.
Does crypto go on Form 8938?
Review the asset, account, custodian, foreign institution, and filing-year thresholds under the Form 8938 instructions. Income reporting and asset reporting are separate questions.
What records should crypto expats keep?
Keep wallet and exchange exports, transaction IDs, dates, fair-market values, fees, cost basis, custody agreements, year-end balances, and currency conversion support.
