Arizona residency is a domicile and presence question

Arizona taxes residents on worldwide income. An individual is an Arizona resident if in Arizona for other than a temporary or transitory purpose, or domiciled in Arizona but outside for a temporary or transitory purpose. Spending more than nine months in Arizona creates a rebuttable presumption of residency. Arizona is not generally considered a sticky state, so ending residency is more straightforward than in states such as California or New York, but domicile still depends on intent and retained ties. A former Arizona resident living abroad should document the move date, foreign home, family location, and severed Arizona ties. Retaining an Arizona driver's license, vehicle registration, voter registration, home, or business interest can support continued residency. The nine-month presumption can be rebutted with competent evidence that the stay was temporary or transitory, but Arizona weighs the combination of ties rather than any single factor.

Arizona's treatment of foreign income

Arizona starts from federal adjusted gross income, so income validly excluded under the FEIE or the Foreign Housing Exclusion generally does not enter the Arizona return. This makes Arizona more generous than many states on foreign earned income. Arizona also allows a credit for income taxes paid to another country on income also taxed by Arizona, but that credit is Arizona's own credit, claimed separately, and is capped at the share of Arizona tax attributable to the income taxed by both jurisdictions. The credit cannot be carried forward. Capital gains included in federal adjusted gross income are included in Arizona gross income and taxed at the flat rate, though Arizona allows a 25% subtraction for net long-term capital gain on assets acquired after December 31, 2011. Rental and investment income is taxed at the flat rate whether the property is located in Arizona or abroad. These rules should be reviewed separately from the federal result rather than copied from it.

Arizona-source income and part-year filing

Nonresidents are taxed only on Arizona-source income, such as rental income from Arizona property, business income connected to Arizona, and wages for work physically performed in Arizona. Part-year residents are taxed on worldwide income during the Arizona resident period plus Arizona-source income during the nonresident period. If a taxpayer moved abroad midyear, a part-year return is generally required for the year of the move. Arizona does not offer expats a separate state extension, but honors the federal extension. An extension applies to filing, not payment, and at least 90% of the Arizona tax liability should be paid by April 15 to avoid penalties. The move date should be chosen from evidence and used consistently across the federal return, Arizona return, employer records, property schedule, travel calendar, and foreign return.

Evidence that supports an Arizona departure

To show that Arizona no longer considers the taxpayer a resident, the file should demonstrate severed ties: surrender the Arizona driver's license, sell or lease Arizona property so no permanent home is maintained there, move banking and mailing addresses abroad, and close or relocate Arizona business interests. Establishing foreign residency also matters: foreign property, local bank accounts, and residence permits strengthen the case. Arizona's flat 2.5% rate applies to all income levels, so the residency determination usually matters more than rate planning. A notice from Arizona should be classified by issue, preserved with its deadline, and answered with an indexed explanation. If the matter involves audit representation or contested domicile, identify that boundary before preparation begins.

Annual review and consultation boundaries for Arizona

A Arizona residency conclusion can change after the move. Revisit Arizona visits, the retained home, family arrangements, new employment, property transactions, business activity, voter or license records, and any return to the United States. Keep an annual tie review with the original departure file. If the taxpayer later buys a home, returns for a long assignment, moves to another country, or changes a rental to personal use, update the analysis instead of copying last year's answer. This is also the time to check current instructions, rates, filing thresholds, and agency forms. Arizona rules are tax-year-specific, and a strong file states which year was reviewed. Bring the last Arizona return, move timeline, foreign residence records, property documents, travel calendar, address changes, income source schedule, federal return, and any notices to a paid consultation. The consultation should identify the state questions, missing evidence, likely forms, source categories, and professional boundaries. It should not promise that a state obligation ended or select a legal position from a short form. If preparation is accepted, the written scope should state the years, returns, schedules, records, assumptions, exclusions, and review steps. If the issue requires audit representation, a state-law opinion, or another credential, that boundary should be identified before preparation begins.

A defensible Arizona file is organized around facts and sources

Use a decision log with four columns: fact, source document, state rule or form affected, and unresolved question. Record the source URL or current state publication for each high-stakes conclusion and note the access date. Mark assumptions separately from verified facts. This prevents a foreign tax return, a residence card, or a federal exclusion from being treated as conclusive proof of a Arizona result. It also makes updates easier when the agency revises instructions or a new notice arrives. Keep final filed returns, payment confirmations, agency correspondence, and calculation workpapers in the same year folder, with sensitive documents handled through the secure exchange process. For each document, write the date, what fact it supports, and any limitation. If a document is in another language, save the original and the required translation or explanation. A reviewer should be able to reconstruct the move without asking the taxpayer to rely on memory several years later.

Remote work and business ownership in Arizona

Remote work requires a Arizona source-income analysis. The employer's address, the client's address, and the bank where compensation was deposited do not automatically determine the state source of service income. Start with where the services were physically performed, then review the contract, payroll records, business activity, and any Arizona workdays. A remote worker who performs all services abroad may have a different result from a person who repeatedly works from a Arizona home. Business owners need separate personal and entity maps; a Arizona customer does not by itself answer whether service income is sourced there, while a Arizona office, employee, inventory, or real property may create a different filing question.

If Arizona remains your domicile or you are a resident, you are taxed on worldwide income. If you are a nonresident, only Arizona-source income is taxable.

Does Arizona have a bright-line day test?

Spending more than nine months in Arizona creates a rebuttable presumption of residency. Shorter stays are evaluated under the temporary-or-transitory-purpose and domicile rules.

How does Arizona treat foreign income?

Arizona starts from federal adjusted gross income, so income validly excluded under the FEIE generally does not enter the Arizona return. Arizona also allows a credit for taxes paid to another country on income also taxed by Arizona.
