Self-Employment Tax for Americans Abroad

Working for yourself from another country creates several separate U.S. questions. You may have business income, deductible expenses, self-employment tax, foreign income tax, information returns, state-tax exposure, and a local-country business registration. The correct order is to map the activity and entity before choosing a form.

Start with the person and the activity

Describe what you do, who contracts with you, where the services are performed, how customers pay, and whether anyone else owns the business. A freelancer providing services personally is not analyzed the same way as a foreign corporation, partnership, or single-member entity.

Collect:

  • Contracts, invoices, payment-platform statements, and expenses.
  • Dates and countries where services were performed.
  • Business registration, ownership, and operating agreements.
  • Foreign tax filings and social-insurance records.
  • Prior U.S. returns, entity elections, and information returns.

Schedule C and business expenses

Many sole proprietors report gross receipts and ordinary, necessary business expenses on Schedule C. Keep a reconciliation from the business bank or payment platform to the U.S. return. Expenses need a business purpose and may require allocation when they also serve personal use.

Foreign-currency records are part of the tax file. Record the date, local amount, exchange-rate method, and U.S.-dollar result. Do not rely on a year-end account balance to reconstruct an entire year of receipts.

Self-employment tax is separate from income tax

The FEIE and Foreign Tax Credit address income-tax calculations; they do not automatically remove self-employment tax. Review net earnings from self-employment, the applicable Social Security and Medicare rules, and whether a totalization agreement assigns coverage to the foreign country. A certificate of coverage or equivalent evidence may be necessary.

For Social Security coverage and a certificate of coverage analysis under a totalization agreement, use the totalization consultation once the worker, employer/business, residence, and work-country facts are mapped.

FEIE, FTC, or both

If the services produce foreign earned income, Form 2555 may be relevant when the physical-presence or bona-fide-residence test is met. Foreign income taxes may support Form 1116 if the tax and source rules are satisfied. The same income cannot be excluded and also support a credit for the related tax. Model the options over more than one year when income is variable.

Foreign entities and Form 5471/8865/8858

A foreign company may be a corporation, partnership, or disregarded entity for U.S. purposes. The classification can trigger Form 5471, Form 8865, Form 8858, GILTI, Subpart F, or other reporting. Do not assume a local LLC is the U.S. equivalent of a U.S. LLC.

Quarterly estimates and state domicile

Clients without U.S. payroll withholding may need quarterly estimates. The calculation should include self-employment tax, foreign credits, the FEIE, and prior-year safe-harbor rules. Separately, a former state may continue to assert domicile or statutory residency until ties are severed and documented.

Do self-employed Americans abroad file Schedule C?

Many individuals who carry on a U.S. trade or business as sole proprietors report business income and expenses on Schedule C, but entity classification, partners, and local business law can change the filing path.

Does FEIE eliminate self-employment tax?

The Foreign Earned Income Exclusion generally does not eliminate U.S. self-employment tax by itself. Review totalization agreements and the applicable Social Security rules separately.

Can I use the Foreign Tax Credit on business income?

Potentially, if the foreign levy and income satisfy the credit rules. Form 1116 source, category, and limitation rules still apply.

Is a foreign LLC automatically a corporation for U.S. tax?

No. A foreign LLC’s U.S. classification depends on its legal form, elections, owners, and the entity-classification rules. The local label is not enough.

Do I need quarterly estimated payments?

You may need estimated payments when withholding is insufficient. Model U.S. income tax, foreign credits, FEIE, and self-employment tax using the current IRS instructions.
