US-New Zealand Tax Treaty: What Americans Abroad Need to Know

The US-New Zealand tax treaty is designed to prevent double taxation. The saving clause preserves the US right to tax its citizens. New Zealand's worldwide income taxation and KiwiSaver system create unique filing questions for Americans.

Key Treaty Provisions

The US-New Zealand tax treaty covers:

  • Income from employment — Taxed where the work is performed
  • Dividends — Reduced withholding rates (15% or 5%)
  • Interest — Reduced withholding rate (10%)
  • Royalties — Reduced withholding rate (5%)
  • Pensions — Generally taxed only in the country of residence
  • Social Security — Taxed only by the paying country

The Saving Clause

The saving clause preserves the US right to tax its citizens and residents. You still file a US tax return and owe US tax on worldwide income even if you live in New Zealand.

KiwiSaver

KiwiSaver (New Zealand's retirement savings scheme) has complex US tax treatment. The treaty does not fully resolve the US tax treatment of KiwiSaver. Contributions may not be deductible on your US return, and distributions may be taxable.

Residency Tie-Breaker Rules

If you are considered a tax resident of both the US and New Zealand, the treaty provides tie-breaker rules:

  1. Permanent home
  2. Center of vital interests
  3. Habitual abode
  4. Nationality
  5. Mutual agreement

Pensions & Retirement Income

Under the treaty, pensions are generally taxed only in the country of residence. For Americans in New Zealand:

  • US Social Security is generally taxable only in the US
  • US pensions and IRAs are generally taxable only in the US
  • New Zealand pensions (KiwiSaver, NZ Super) are taxable only in New Zealand

Totalization Agreement

There is no U.S.-New Zealand Social Security agreement in force.

What the Treaty Does NOT Do

  • Does not exempt US citizens from US tax (saving clause)
  • Does not eliminate FBAR or FATCA reporting
  • Does not fully resolve KiwiSaver US tax treatment
  • Does not change your US filing obligations

Practical Implications for Americans in New Zealand

New Zealand's tax rates (up to 39%) make FTC valuable. KiwiSaver complexity requires professional attention. The treaty's main practical benefit is reduced withholding on New Zealand-source income.

For most Americans in New Zealand, FTC is more valuable than FEIE due to high New Zealand rates.

When to Get Professional Help

You should consider professional help if you have questions about treaty benefits, KiwiSaver US tax treatment, pension taxation, or cross-border income.
