Netherlands DAFT Visa for Americans: Self-Employed Residency & Tax Guide

How Americans can use the Dutch-American Friendship Treaty to become self-employed in the Netherlands, including the EUR 4,500 investment, permit validity, and Dutch tax residence.

The Dutch-American Friendship Treaty (DAFT) route lets U.S. citizens obtain a Dutch residence permit to start and run a business in the Netherlands. Instead of the points-based test used for other nationals seeking self-employment, Americans can qualify by investing a substantial amount of capital, generally at least EUR 4,500, in a Dutch business. The permit is initially valid for two years and can be renewed for five more years, after which permanent residence may be possible. DAFT is not an employee work permit: the holder may work only for their own business, and family members on dependent permits also need a change of status to take regular employment. This guide covers eligibility, investment, business setup, renewal, and Dutch tax residence.

Eligibility

  • You must hold a U.S. passport.
  • You must start and run a Dutch business, or represent an American company in the Netherlands.
  • You must invest at least EUR 4,500 as starting capital in the business.
  • You must not have a record of misbehaviour in the Netherlands.
  • You must register your business and open a Dutch business bank account.
  • You must undergo a tuberculosis test if required.
  • You do not need an MVV to enter the Netherlands as a U.S. citizen, but you must complete IND registration.

Tax implications

A U.S. citizen who lives in the Netherlands on a DAFT permit may become a Dutch tax resident under Dutch facts-and-circumstances rules. Dutch tax residents are generally taxed on worldwide income, while non-residents are taxed on Dutch-source income. The U.S.-Netherlands tax treaty and the foreign tax credit can reduce double taxation. The Dutch 30% ruling may be relevant if a BV employs you as a director, but it is not available to a ZZP. Self-employment income is subject to Dutch income tax and social security contributions, and the FEIE may apply only if you have eligible foreign earned income and a qualifying period. U.S. citizens still file U.S. returns and may have FBAR or Form 8938 obligations.

Country-specific planning

Dutch tax residence is not based on a fixed day count. The Belastingdienst applies a durable-bond test that weighs home, family, work, economic ties, and days in the Netherlands. Having a home or family in the Netherlands can trigger residence even with fewer than 183 days. The 183-day rule applies mainly to treaty allocation of employment income, not to Dutch residence itself. The 30% ruling has been reformed and is subject to conditions and time limits. This is U.S. tax preparation scope only; Dutch tax and immigration questions should go to qualified Dutch professionals.

How DAFT works

DAFT stems from a 1956 treaty between the United States and the Netherlands. It gives American entrepreneurs and freelancers a predictable residence route by requiring a substantial capital investment rather than a points test. You can choose a sole proprietorship (ZZP) or a private limited company (BV). A BV can offer limited liability and potential access to the 30% ruling if it employs you as a director, while a ZZP is simpler but has unlimited liability. The IND does not consider borrowed capital as part of the investment, and the business must not be an empty shell at renewal.

Investment and setup

For a sole proprietorship, the IND generally requires at least EUR 4,500 of capital that can be used to exploit the business. For a BV, the requirement is at least 25% of paid-in capital with a minimum of EUR 4,500. You must register with the Chamber of Commerce, open a Dutch business bank account, make the deposit, and register your address. As a U.S. citizen you do not need an MVV to enter, but you must complete IND biometrics and registration. The IND can conduct retroactive checks after the setup window closes.

Permit validity and renewal

The initial permit is valid for two years. During that time you develop and direct your business. On renewal, the IND asks for evidence of real activity and may extend the permit for five more years. After five years of residence you may apply for permanent residence. You may bring your partner and minor children, but they generally need their own permits. Family members may face restrictions on regular employment, so confirm current IND rules before relying on dependent work rights.

Dutch tax residence and U.S. filing

Dutch tax residence is based on a durable bond with the Netherlands, weighing home, family, work, economic ties, and days spent. There is no fixed day threshold, and having a home or family in the Netherlands can trigger residence. Residents are generally taxed on worldwide income; non-residents are taxed on Dutch-source income. The 30% ruling has been reformed and applies only to qualifying employment relationships, not to a ZZP. Self-employment income is subject to Dutch income tax and social security contributions. The U.S.-Netherlands treaty and foreign tax credit can reduce double taxation. Track ties for both Dutch residence and U.S. tests, and keep records for FBAR and Form 8938. FileAbroad handles U.S. tax preparation only.

Planning your move

Decide between a BV and ZZP before you apply, because the choice affects liability, tax, and eligibility for the 30% ruling. Arrange a Dutch bank account, accountant, and Chamber of Commerce registration early. Budget for Dutch income tax, social security, and possible VAT obligations. If you may become Dutch tax resident, model Dutch and U.S. filing together, including self-employment tax and any totalization agreement. Tell me about your situation at /intake.

Frequently asked questions

How much must I invest for a DAFT permit?

The IND generally treats EUR 4,500 as a substantial amount of capital for a sole proprietorship, and higher minimums apply to some corporate forms. Borrowed capital does not count.

How long is the permit valid?

The DAFT permit is initially valid for two years. On renewal it can be extended for five more years, and permanent residence may be possible after five years.

Can I take a regular job on a DAFT permit?

No. The permit allows self-employment only. If you want to work for another Dutch employer, you need a separate permit.

Can my family work?

Dependent family members may join you, but they generally cannot take regular employment without a change of status. Some sources note that partners and children of DAFT holders have broader work rights, so confirm current IND rules.

Does the permit make me a Dutch tax resident?

Not automatically. Dutch tax residence depends on the totality of your personal and economic ties to the Netherlands, not on the permit alone.
