Moving to Portugal from the US: Tax Checklist for Americans

Moving to Portugal is exciting, but the tax implications start before you leave. Pre-move planning can save you thousands in taxes and prevent costly mistakes. This checklist covers the key tax steps before, during, and after your move.

Before You Move (3-6 months before)

State Tax Exit

  • If you live in California, New York, Virginia, or another aggressive state, plan your exit carefully
  • Surrender your driver's license and obtain a new one (or plan to obtain a Portuguese license)
  • Cancel voter registration
  • Sell or rent out property (or document your intent to leave)
  • Close or minimize bank accounts in your former state
  • Consider establishing residency in a no-tax state (Texas, Florida, Nevada) before moving abroad

FEIE Planning

  • Understand the physical presence test (330 days outside the US in a 12-month period)
  • Plan your move date to maximize your first-year FEIE
  • Keep detailed travel records from day one

NHR/IFICI Planning

  • Research whether you qualify for NHR or IFICI
  • NHR requires that you were not a Portuguese tax resident for the 5 years prior
  • IFICI (2024 replacement) is narrower — check if your profession qualifies

Banking

  • Open a Portuguese bank account (requires NIF)
  • Keep at least one US bank account open for US income and expenses
  • Understand FBAR reporting requirements

First Year Filing

Partial-Year FEIE

In your first year abroad, you may qualify for partial-year FEIE. You can claim FEIE for the period you were a bona fide resident or met the physical presence test.

Portuguese Tax Residency

You become a Portuguese tax resident if you spend more than 183 days in Portugal or have a habitual abode there. Your first year may be split between US and Portuguese tax residency.

FBAR

File FBAR for all foreign accounts, including Portuguese accounts, if the aggregate value exceeds $10,000.

Establishing Portugal Tax Residency

  • Obtain a NIF (NĂşmero de Identificação Fiscal)
  • Register your address (registo de residĂŞncia)
  • Open a Portuguese bank account
  • Register with Segurança Social (if self-employed)

Banking & FBAR Setup

  • Open accounts at Millennium BCP, ActivoBank, or Caixa Geral
  • Keep records of account opening dates and balances
  • Plan for FBAR reporting from year one

Common Pre-Move Mistakes

  1. Not planning state tax exit — California and New York can follow you abroad for years.
  2. Not tracking travel days — You need 330 days outside the US for the physical presence test.
  3. Opening Portuguese accounts without understanding FBAR — All foreign accounts are reportable.
  4. Assuming NHR is automatic — You must apply and qualify.

Timeline Checklist

3 months before:

  • Research NHR/IFICI eligibility
  • Plan state tax exit strategy
  • Obtain NIF (can be done remotely with a fiscal representative)
  • Open Portuguese bank account

1 month before:

  • Surrender state driver's license (if needed)
  • Cancel state voter registration
  • Document your move (lease, utility bills, etc.)
  • Set up travel tracking system

First month in Portugal:

  • Register address (registo de residĂŞncia)
  • Register with Segurança Social (if self-employed)
  • Open local bank account
  • Set up healthcare (SNS registration)

First tax season:

  • File US tax return with FEIE
  • File FBAR
  • File Portuguese tax return (if resident)
  • Make quarterly estimated tax payments (if self-employed)
