- PFIC rules: If the SIPP holds PFIC stock and a Form 8621 filing trigger applies, Form 8621 may be required.
The US-UK Tax Treaty
The U.S.-UK treaty's pension provisions may affect the treatment of pension income, but the result depends on the relevant treaty text, protocols, residence, saving clause, and whether the arrangement qualifies as a pension scheme. Treaty treatment of a distribution does not automatically answer trust, PFIC, or information-reporting questions during accumulation.

- Model any transfer: A self-directed option may change investment choice but does not by itself settle the U.S. reporting position.
Form 3520 Filing for SIPPs
Contributions
- Employer contributions, employee contributions, and UK tax relief may need to be analyzed as plan contributions or transfers under the applicable U.S. rules.
- Do not treat the HMRC "relief at source" mechanism as an automatic Form 3520 filing result.
Distributions
- UK access rules and any tax-free amount are separate from the U.S. tax result.
- The U.S. may not mirror a UK exemption or tax-free treatment, and the treaty may change the result.
